Fun Belgium – Management of IP Portfolio

The Client

FUN Belgium is a Belgian company active of approximative 250 employees and 29 stores active in retail sale of games and toys. Do to the nature of its activity, Client is often challenged with incriminating new trademark applications

The Project

FUN actively protects and defends its IP rights through IFORI. IFORI has sent several cease and desist letters to counterfeiters , as well as conducted multiple oppositions. During these opposition procedures, IFORI was able to convince the EUIPO (European Union Intellectual Property Office) that the mere fact that a trademark has a limited degree of distinctiveness with respect to the goods does not preclude a finding that there can be a likelihood of confusion.

The Outcome

Today, Client still defends its many trademark registrations thank to IFORI. Based on the several rulings of the EUIPO, FUN is able to easier take down new trademark applications it finds incriminating.
