Whistleblowing & Compliance

There are new rules around setting up reporting channels and protecting whistleblowers for possible breaches in various policy areas. This was defined at European level in the European Whistleblowing Directive (Directive 2019/1937) and sets out rules and procedures to protect “whistleblowers”.

The legislator wants to give these persons the necessary protection, for example, there must be:

  • Secure and accessible reporting systems that provide whistleblowers with a platform to enable reporting,
  • Offer better protection against retaliatory measures, such as suspension or dismissal,
  • Feedback obligation for organisations to respond and act on such reports within 3 months.

The Belgian transposition of the whistleblowing directive for the private sector, came into force on 15 February 2023. Public bodies are also subject to similar rules.
